Best: Cavaliers @ Lakers: Is LeBron the next Jordan? He has to be better than Kobe to be better than MJ (and of course Kobe isn’t Jordan either). The big difference between Kobe and LeBron is that James does the stand-around-but-get-rebounds-anyway defense that T-Mac does. James should Scottie Pippens defense to see how a free-flowing SF should play defense. Predicted Score: Los Angeles Lakers win 103-96

Runner-up: Warriors @ Suns: Golden State is having a surprising season but is off and on. Both Baron Davis and Jason Richardson play great, but not always at the same time. Richardson has to dominate night in and night out like Nash and Marion do. 3-pt shooting will be a no-brainer between the two, but rebounds might be scarce. Predicted Score: Phoenix wins 107-101

Blowout: Pistons @ Spurs: Yeah it may be a clash of two NBA titans. But if the NBA Finals taught us anything last year, it was these two don’t exactly play games for entertainment. Even Jazz/Bulls had a 40+ point blowout before Jordan hit the game-winner in Game 6. One blowout deserves another, and the low score in this game will make it even less entertaining for fans. Predicted Score: San Antonio wins 96-81

The Six Degrees Of Networking

Let’s talk about your network. Whether you know it or not you have several different types of networks: business, family, friends, community, acquaintances and so on. So, what are you doing to build and/or maintain the relationships in those networks? Let’s face it. Not all relationships require the same strategy or plan for maintenance. It is, however, important to understand that more positive results come from networking in a professional manner. It is very important to treat your network with kid gloves. Continued contact proves to maintain and cultivate the relationship no matter how it evolves.

There may be people you don’t even who know have the power to influence the outcome of a particular situation you’re in. Worse yet, you may never ever know it even after having lived through it. Sometimes it’s just a matter of who knows you or whom you have met. It may depend on whom your family knows, whom your cleaning lady knows, or on whom your child’s teacher knows.

See the associations? Get the point? We are all connected and some say that it only takes six “connections” to come full circle back to you. Keep that in mind as you cultivate your network. Not only are the people that you come in contact in your network but they also have ancillary connections to your network.

Consider this example:
Person A ? This person knows you fairly well. You have been at events together and an informal bond of friendship established. You communicate on a sporadic and irregular basis about work issues. Person A falls of the face of the earth for six months and does not respond in any way to your attempts at communication. Suddenly, Person A needs a job and he/she illicit your help.

This is a tough call. Will you help him/her?

Consider these points when making your decision:

Person A gets back to you only when her/she needs something. If you help person A is he/she likely to fall of the face of the earth afterwards? Will person A reciprocate when you need assistance? Is it worth your time and energy to help person A? Remember, everyone has a limited amount of time and resources. You need to continually assess how to maintain your relationships without monopolizing your time.

Person B - You know this person in a business sense as well. Person B sends you periodic notes and picks up the phone to call you and answers when you contact her. This person does communicate, even if it’s just a quick email.
Would you help this person? Consider these points in making your decision.
Person B genuinely makes an effort to stay in touch. Person B would most likely really appreciate your efforts and remember it when he/she is in a position to do you a favor.

Sound like hardball? Remember it’s your time and you have to make the best use of it. If Person A were no longer in your life would you miss him/her, need his/her assistance in the future? Could he/she influence your career in some way? You be the judge.

The safest path is to be honest and tell the person how you feel (in a nice way, of course). I’m sorry I can’t help you with your job search. If you had stayed in touch I would be better prepared to help? If they get their feelings hurt, too bad. You are operating with professionalism.

The 6 degrees of separation:
Lets consider A & B again. A or B gets a new job. It’s not all that uncommon for an acquaintance to turn up within your circle of business or become a person of influence. Small world syndrome! What’s in it for you? Would you want to work for them? Could you have them serve as a reference? Is this someone you need to cultivate on an ongoing basis to further your career? Can you strengthen the relationship by helping this person and therefore positioning yourself in a more favorable light?

Imagine that A or B knows your boss socially. Would he/she be likely to speak of you favorably? A or B becomes a decision maker in his/her new position. He/She is now someone you need to call on. Will he/she have an open door policy? Will she/he hold a grudge forever because you did not help him/her previously? Would he/she then speak unkindly of you among acquaintances? A or B is now your enemy and feels slighted because you didn’t help her/him. What possible influence can she/he have on your career? A or B hits a rough patch. Do you feel guilty for not helping him/her if it had been in your power to do so?

Do you see how we have come full circle? Someone you know as an acquaintance today could be your boss or control your boss tomorrow. Your cleaning lady could clean the house of your next boss. Or you could be sitting next to your future employer at a PTA meeting. That being said, the best course of action is to remain professional. Even if you feel that you have been taken advantage of or imposed upon. Strategically, it is important to stay professional in all phases of our lives. What goes around comes around. It may not even take six degrees to do that!

Saying ‘No’ Gracefully to Customers and Colleagues

Envision the scenario: You’ve just been asked at the last minute by Chris, the organizer of your local networking group, to replace the scheduled speaker at next month’s meeting. You already have too many commitments on your plate. Imagine your response:

You: “Well, I don’t think I’d have enough time to prepare. I’m awfully sorryI wish I could help you!”

Chris: “Your last speech was supermaybe you could just talk some more about that topic? I’d really appreciate it!”

You: “I’m glad you liked it–maybe I could do it…

Chris: “Oh that would be great! Just let me know the title…” …fade

How might you feel about doing this speech? You might feel stressed or resentful. You might not be at your best when you do the speech. Other work that you’d really like to be doing might suffer.

Now imagine a different response:

You: “No, I can’t be prepared on such short notice. I know how hard it is to find someoneAlex speaks on a variety of topics and I think she could fill in for you. I’ll give you her number.”

Chris: “Thanks! That will really help.”

This is a win-win-win: Alex gets an opportunity to speak (her specialty), Chris gets a speaker, and you aren’t saddled with a commitment you don’t want–plus, you’ve probably earned some good will from both Alex and Chris. What a difference!

Whether you are saying no to a collaborator asking you to do something, or saying no to a potential client that you really don’t want to have, the ability to say no gracefully is a key skill when you are in business as a solo entrepreneur. Here are four quick steps to learning this skill:

1. Understand the reasons you say “yes”, even when you don’t really want to. Here are some common reasons; which ones apply to you?

– You want to please people; you don’t want to hurt anyone’s feelings.

The customer is always right, you can’t say no to the customer!

– It’s not polite to say no; if you say no you feel you are being self-centered.

– You are flattered by the request.

– You feel like you need the business!

– You can’t think of a nice way to say no fast enough.

–You think there might be other unforeseen negative consequences if you say no.

2. Recognize the good things that can come out of saying “no”:

– You have more opportunities to say “yes” to the right customer.

– You have more time to do the things you *want* to do.

– Saying no expresses how you *really* feel. You are taking responsibility for your own feelings and letting others take responsibility for theirs.

Someone else who really wants this customer’s business, has a chance to get it

3. Learn how to say “no” gracefully:

– “No, I can’t do that.” Don’t beat around the bush-put “no” right upfront.

– Use non-verbal cues to underscore the “no”-shake your head; use a firm and direct voice, use eye-contact.

– Add an explanation if you want, but don’t apologize: “I have another commitment.” - even if that commitment is to yourself!

– Be empathetic if the situation calls for it: “I know how hard it is to find a tax-preparer at this time of year.”

– Recommend an alternative if one is available: “Let me refer you to…”

– If you’re not sure, it’s always OK to ask for more time to think it over!

4. Practice your new skill:

– Rehearse ahead of time if you think it will help. Role play with your business coach or a friend or colleague.

– Choose a low-risk situation first. Practice on your significant other, family, friends. Or practice on strangers, if that’s easier for you: the salesclerk who wants to sell you one more thing, the telemarketer calling at dinner.

– Work your way up to friendly clients. They are likely to appreciate the boundaries you are setting!

– When you have the courage to fire that client who hasn’t paid and makes unreasonable demands-you’ll know you’ve mastered saying “NO!” (Hint: refer them to someone else that is a better fit and help manage the transition!)

Saying “no” gives you freedom. It is a way of honoring both yourself and the person you are saying “no” to. Learn to do it well, and you will earn the respect of others–and yourself!

Tales of Email Misdirection

It’s wise to remember how easily email — this wonderful
technology — can be misused and misdirected, sometimes
unintentionally, with serious consequences. Unless you are using
encryption, the privacy of your message cannot be guaranteed nor
the authenticity of your correspondent.

Consider the case of a man who left the snow-filled streets of
Chicago for a vacation in sunny Florida. When he reached his
hotel, he decided to send his wife a quick email, who was
planning to meet him there the next day.

Unfortunately, when typing her address, he missed one letter,
and his note was directed instead to an elderly preacher’s wife
whose husband had just passed away. When the grieving widow
checked her email, she took one look at the monitor, let out a
wail, and fell to the floor in a faint.

At the sound, her family rushed into the room and saw this email
note on the screen:

“Dearest Wife, Just got checked in. Everything prepared for your
arrival tomorrow. P.S. Sure is hot down here.”

What actually hurts here is that the email was not being
intercepted but rather, inadvertently directed to the wrong
location. The nickname feature in many mailers can cause
accidental emails being sent to co-workers instead of family
members, or vice-versa. It’s a strange new kind of
miscommunication, where you can misdirect emails a dozen times
before lunch. At least with misdialed phone numbers it becomes
apparent after a few moments and you usually stop before saying
too much. With email, it is now possible to quickly send a
completely coherent message that is nonetheless nearly
incomprehensible to a mistaken recipient.

Bigger mistakes can come from an accidental “reply” or even
worse, “reply all” instead of “forward”. A recent example would
be when a congressional staffer accidentally hit “reply all”
when intending to forward a comment to fellow staffers on a
“Support the Captive Primate Safety Act” email he’d received
from an animal rights group. The original email was supporting
legislation to prohibit the keeping of primates such as monkeys
and great apes as pets, and asking for co-sponsors to protect
not only animals but humans as well, as there are inherent
dangers in keeping such pets. The staffer’s comment was meant to
be funny, and read: “Does this deal with those kids out in
Ohio(?) who were kept in cages?” However, this email went out to
the legislators behind the Captive Primate Safety Act instead of
being forwarded as an inside “joke”, leading to a very sticky
political exchange.

Other instances of email misdirection puts organizations In
legal and/or financially risk, causing a number of compliance
issues. A 2005 Harris Interactive® for Fortiva poll, shows that
68 per cent of U.S. employees who use email at work have sent or
received email via their work email account that could place
their company at risk.

While all these examples may be a good arguments as to why you
should disable the “reply all” function altogether, the fact
remains that the way a standard, unprotected email is sent out
is very akin to the mailing of a postcard. With the wrong
address attached there is nothing, not even an envelope, to
dissuade an unintended recipient from reading about, for
instance, the naughty things you did while in Vegas. Even worse,
the mistaken recipient can in turn “reply” and you could be end
up with unsolicited correspondences for the lifetime of that
email address.

Use it wisely, and email is indeed a wonderful tool. Email is
fast, easy to use and has become a cultural method of propelling
personal and business communication. The bottom line is this -
do not trust confidential information to email unless you are
using security such as encryption or rights management. Whether
it’s due to misdirected email or breach of email etiquette, your
email could be exposing yourself to more than you know.

California provides for defendant’s right to jury, which is not available in many states. The state provides a 30-day period for trial after the arrest is made. This 30 day period is useful to prepare for the case.

The important process in the DUI case is the defense when the DUI lawyer defends the DUI accused by different tactics and cross examining the arresting officer. The verdict involves unanimous agreement of all the jury members in the panel. Even if one jury is in favor of the defendant, the defendant is held free.

The complexity of DUI laws gives scope for limitless defense strategies and tactics for lawyers. The strategies are framed according to the different cases, depending upon the results of Field Sobriety Tests, blood, breath or/and urine tests, co-operation of the accused during the time of arrest, previous record of the defendant and the nature of respective state laws. Generally the defense is done on any of the following. Rising Blood Alcohol Concentration (BAC) and retrograde testing involves challenging the actual concentration of alcohol at the time of driving. The role of a non-medical arresting officer in establishing the ‘driving under influence’ can be questioned. Finally the defense can be in establishing the credibility of the test procedure and the machine.

Some of the tactical defenses include questioning the validity of the test results if the ‘implied consent warning’ part is not done by the arresting officer. Similarly there are many other tactics employed by lawyers, which come with experience and expertise.

Breaking Down Tennesse Vs. Florida

On Florida:

Florida had two easy victories to begin the year. Beat an underrated Wyoming team to begin the year, 32-14. Then blew out overmatch La Tech 41-3.

QB Chrik Leak looks as though he can run Urban Meyer’s offense, but he will be tested in this game more than the last two put together. But, on offense the big question will be whether the Gators can establish a running game against the Vols tough front seven.

After sitting out the opener due to a suspension, running back DeShawn Wynn scored three touchdowns and rushed for 101 yards on 16 carries in the last game.

Gators still have problems along the offensiive line, which they’ll need to take of in a hurry.

On defense, Florida’s guys have been impressive, albeit against inferior offenses. Luckily for their unproven secondary, Tennessee’s QB situation is a little bit of a question mark. They can expect to see a whole lot of Gerald Riggs in this big rivalry game.

About Tennessee:

Tennessee survived a scare from UAB two weeks ago, where Rick Clausen captured the starting QB job from Erik Ainge. Clausen replaced Ainge and completed 17 of 24 passes for 217 yards with one touchdown and one interception. Ainge completed just five of 14 passes for 57 yards, with one touchdown and two interceptions.

Like stated earlier, expect to see plenty of RB Gerald Riggs. Also, don’t be surprised if you see both QB’s split time in this game.

The Vols had a bye last week to prepare for this one, but it may not be an advantage. Fulmer has had off weeks to prepare for the Gators before and lost 5 of those 6 times in the Spurrier era.

The positive about the off week is that it gave Tennessee a chance to get some of their players healthy, namely C Richard Gandy (knee), WR Robert Meachem (ankle) and LB Jason Mitchell (knee)

Fulmer was not happy with what he saw out of his squad in the opener.
“Offensively, it was the silly interceptions, the silly dropped balls, the tip-toeing around of running backs, the tip-toeing around by the offensive linemen,” Fulmer said. “We came out and practiced not tip-toeing.

“It’s all of us. It’s receivers blocking down field consistently, the running backs making a cut, the fullback finishing a block. On offense, you’ve got to have everybody on the same page doing the right things.”

Defensively, expect the Vols to bring plenty of pressure against Leak and the questionable offensive line of Florida. The front seven want to be in the backfield all day. They faced a similar QB in Hackney, but Leak is qite a bit better.

Florida will try to wear out this defense in the Florida heat.
